This research summarizes the background and developments of the request for an advisory opinion issued by the International Court of Justice on 21-05-2026 concerning "The Right to Strike in Light of ILO Convention No. 87." This request stemmed from a decision by the Governing Body of the International Labour Office, during its special session held on 10-11-2023, to request an urgent advisory opinion on whether the right to strike for workers and their organizations is protected under ILO Convention No. 87 of 1948 concerning Freedom of Association and Protection of the Right to Organise. The Court received the request on November 13, 2023, and issued an order on November 16, 2023, establishing the eligibility of the International Labour Organization (ILO) and States Parties to the Convention to submit information and written submissions by May 16, 2024, and written observations by September 16, 2024. The Court also accepted the participation of non-Parties to the Convention, such as the United States and Brazil, by virtue of their membership in the ILO.
